Terms & Conditions (Pragmana Foundation)

  • Effective Date: 27 July 2025 (IST)

     

  • Who we are: Pragmana Foundation (“Pragmana”, “we”, “our”) provides well‑being and mental‑health support offerings such as listening circles, support groups, and individual/peer/academic counselling through our website (“Site”) and online/in‑person formats (“Services”).

     

  • Eligibility: You must be 18+ to register and purchase. If you are under 18, a parent/guardian must consent and complete bookings on your behalf.

     

  • Accounts and bookings:

     

    • Accuracy: Provide true, accurate, and complete information.

       

    • Security: Keep your login secure; you are responsible for activities under your account.

       

    • Use: Book only for yourself or a dependent for whom you are legally responsible.

       

    • Confirmation: All bookings are subject to availability and confirmation.

       

  • Programmes and Services:

     

    • Operational changes: Dates, duration, facilitators, group size, and eligibility may change for operational reasons.

       

    • Notice: We will make reasonable efforts to inform you of material changes.

       

  • Payments and pricing:

     

    • Prices: Fees are shown in INR unless stated otherwise and may change without prior notice.

       

    • Taxes: You authorise charges including applicable taxes.

       

  • Payment gateway (Razorpay/PhonePe):

     

    • Processors: Payments are processed via Razorpay and/or PhonePe (modes such as cards, UPI, netbanking, wallets as enabled by the gateway).

       

    • No card storage: Card details are not stored by the website; they are processed securely by the payment gateway.

       

  • Receipts and invoices: You will receive a payment confirmation/receipt to your registered email/phone where available.

     

  • Communications, WhatsApp, and automation:

     

    • Service messages: By sharing your contact details, you consent to receive service‑related communications (email/SMS/phone/WhatsApp) for confirmations, reminders, programme updates, support, and feedback.

       

    • Tools: We may use the WhatsApp Business API and customer‑engagement automation tools (templates, chatbots, scheduled messages). Standard network/data charges may apply.

       

  • Marketing messages and opt‑out: We send marketing/promotional messages on WhatsApp/SMS/email only with your consent. You can opt out at any time by replying “STOP” on WhatsApp or SMS, using the unsubscribe link in email, or writing to us. Essential service messages will continue.

     

  • Behaviour and safety: Follow facilitator guidelines to maintain a safe, respectful environment. Pragmana may remove any participant whose behaviour is disruptive or unsuitable for a group (see Cancellation & Refund Policy for refund outcomes).

     

  • No medical or crisis advice: Our Services are supportive in nature and are not a substitute for medical diagnosis, treatment, or emergency care. In an emergency or crisis, contact local emergency services or a qualified professional immediately.

     

  • User content and feedback: If you share feedback, reviews, or materials, you grant Pragmana a non‑exclusive, royalty‑free licence to use, display, and share such content for legitimate purposes (for example, improving Services and testimonials) in line with our Privacy Policy.

     

  • Intellectual property: The Site’s content, designs, logos, and materials are owned by or licensed to Pragmana. Do not copy, modify, or distribute except for personal, non‑commercial use.

     

  • Third‑party services: We may link to or integrate third‑party tools (for example, Razorpay, PhonePe, WhatsApp Business API providers, scheduling/communications, analytics). Their terms and privacy practices apply; we are not responsible for third‑party outages or actions.

     

  • Availability: We strive for reliable access but do not guarantee uninterrupted or error‑free operation. Maintenance, updates, or factors beyond our control may cause temporary unavailability.

     

  • Warranties and limitation of liability: Services are provided on an “as‑is” basis to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid for the specific Service giving rise to the claim.

     

  • Indemnity: You agree to indemnify Pragmana against claims arising from your misuse of the Site/Services or breach of these Terms.

     

  • Cancellations and refunds: See the Cancellation & Refund Policy below.

     

  • Changes to Terms: We may update these Terms periodically. Continued use after changes means you accept the updated Terms.

     

  • Governing law and jurisdiction: These Terms are governed by the laws of India. Courts at Gurugram, Haryana, shall have exclusive jurisdiction.
